MSME Form 1- MCA’s relief to MSMEs against outstanding payments
The MSME Form 1 is a semi-annual return that certain Indian enterprises must submit to the Ministry of Corporate Affairs (MCA) in order to report their unpaid invoices to Micro, Small, and Medium Enterprises (MSME) suppliers. This form's main objective is to maintain track of businesses that still owe MSMEs money while also making sure that MSME suppliers get paid on schedule.
- Applicability of MSME Form 1
Companies that fall under the following categories must submit an MSME Form I:
- Businesses that have purchased products or services from MSMEs
- Companies who pay MSMEs more than 45 days after the products or services are accepted or are judged to have been accepted
The Ministry of MSME has issued guidelines on the applicability of MSME Form 1. According to the guidelines, every specified company shall file in MSME Form 1 details of all outstanding dues to Micro or small enterprises suppliers existing on the date of notification of this order, which is 2nd November 2018.
- Due Date for Filing MSME Form 1
The due date for filing MSME Form 1 is 30 days from the end of each half-year, i.e., 30th April and 31st October. Companies must ensure that they file the form within the due date to avoid penalties.
- Filing Procedure for MSME Form 1
To file MSME Form 1, companies can visit the MCA website and download the form. The form requires companies to provide details of their outstanding dues to MSME suppliers, which includes:
- CIN and PAN of the company:
- Name, address, and e-mail of the company:
- Total outstanding amount due against supply of goods or services:
- Name and PAN of each supplier:
- Amount due to each supplier:
- Specify the date from which amount is due:
- Reason for delay in payment:
The form allows a maximum of 99 entries for reporting outstanding payments to MSMEs. If there are more than 99 entries, multiple forms must be filed accordingly. Companies must ensure that they provide accurate information in the form to avoid any discrepancies.
